Reservation conditions with Club Emeraude

  • Reservations can be made: directly at the club, by phone, by email and on the online reservation platform of the website.
  • A deposit of 30% of the total amount of the booked service will be requested, or the total amount according to possibilities.
  • On the spot, payment can be made in cash, credit card, checks, ANCV checks.
  • Reservation by e-mail or telephone: a payment (or 30% deposit) by credit card is required, secure payment service via iZettle.com. The terms of this payment are set out at the time of the sale.
  • Online booking on the dedicated website platform: the total amount of the service is requested in payment by credit card

Reasons for the cancellation of a service by Club Emeraude

  • The decision to cancel a service due to weather conditions is the sole responsibility of the people in charge of the group and the individuals. This decision is sovereign.
  • An outing can only be cancelled due to weather conditions if they pose a risk to the practice of the activity.
  • Club Emeraude reserves the right to cancel a service if the minimum number of 5 participants (per group) is not reached. Club Emeraude reserves the right to cancel a service if the minimum number of 3 participants per sailing course group is not reached.
  • In case of cancellation decided by Club Emeraude, a solution in the form of a credit note will be proposed to the customer.
  • In case of cancellation decided by Club Emeraude, any amount previously paid will be fully refunded to the client. They can be paid on a pro rata basis of the services already provided (e.g. for sailing courses) in relation to the overall service.
  • For any service whose total amount is equal or superior to 1500 € and which has to be cancelled due to unfavorable weather conditions, Club Emeraude will reimburse the client the deposit minus 10% of the total amount, which corresponds to the costs incurred for the organization of the service.

Reservation by internet or by phone & cancellation policy

  • The customer will receive by internet or by phone the necessary information for the outing (date, time and place of appointment, material to take, amounts to pay, means of payment …).
  • No deposit will be required for services of less than 50€ including VAT.
  • A deposit of 30% of the total amount is required from the customer for services over 50€ including VAT.
  • For any partial or total cancellation of the customer announced until 7 days before the date of the service, the deposit is refunded to the customer.
  • For any partial or total cancellation by the client notified between 7 days and 48 hours before the start time of the service, Club Emeraude will keep the deposit.
  • Any partial or total cancellation by the client must be notified at least 48 hours before the start time of the service. Otherwise, the customer will not be reimbursed for the deposit paid.
  • Any partial or total cancellation by the client, due to a case of force majeure, will result in the reimbursement of the deposit and the non payment of the service. The customer will then have to provide Club Emeraude with a proof (medical certificate or official document).

Quote

  • For services requiring an estimate, the sale is considered final after the provider has established an estimate and sent it to the buyer. The latter will then have to confirm by signing the aforementioned estimate with the mention “good for agreement” and send it back to Club Emeraude with the payment of the deposit (under the same conditions above).
  • The estimate that is established by Club Emeraude is valid for one month.

Modification by the customer

  • Any modification made by the customer on essential elements (change of program, date, number of participants…) will be considered as a cancellation and will involve the same fees.

Insurance

  • Club Emeraude has taken out Professional Liability insurance for its own activities. (Gan assurances, 7 rue des Faisans, 66700 Argeles sur mer)
  • Club Emeraude cannot be held responsible for activities booked with its partners.
  • Each participant must ensure that they have personal accident insurance (often linked to home, vehicle or credit card insurance).
    However, each instructor has a Professional Liability Insurance for the technical supervision of nautical and sailing activities.

General and Sanitary Recommendations

  • We would like to inform our clients that some of the services offered by Club Emeraude are sports, leisure and recreational activities in the great outdoors, which can be risky.
  • Accept all safety conditions without restriction.
  • To accept without restriction all the instructions given by the instructor, the persons in charge.
  • When you register, you should make sure that you are in sufficiently good physical condition before committing yourself and that you report any pathologies or traumas that may have occurred previously or currently. In any case, do not overestimate yourself. Please inquire before booking.
  • For all sea activities except pedal boat rental, it is essential to be able to swim.

Care of Young Minors

  • Except in special cases, and at the discretion of the organizer, minors under 13 years of age not accompanied by an adult (legal guardian, father, mother, guardian, adult brother or sister) are not accepted.
  • Minors from 13 to 17 years old, if they are not accompanied, are admitted after signing a parental authorization and under certain conditions (sport level, ability, medical contraindications…)
  • For groups such as ALSH, vacation camps, etc., the regulations apply when they come.

Audiovisual Property and Image Rights

  • By participating in one of our activities, you expressly accept, without restriction, that your image may be used for promotional and advertising purposes on all our “paper” media and our modern communication and telecommunication tools (Videos, Photos, Website, Social Networks), unless you request it directly to the person in charge, orally, by telephone or in writing (SMS or e-mail).

Jurisdiction and mediation

  • All the litigations to which the operations of purchase and sale concluded in application of the present general conditions of sale could give place, concerning so much their validity, their interpretation, their execution, their cancellation, their consequences and their continuations and which could not have been solved with the friendly one between the salesman and the customer, will be subjected to the courts of competent jurisdiction under the conditions of common law.   • The customer may have recourse to conventional mediation, in particular with the Commission for Consumer Mediation or with existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
